Damico's decided that with ICE cracking down and raiding employers, it would take the "no match" letters they get on employees' SSNs seriously, set a deadline and then fire anybody who couldn't provide correct SSNs.

Now they are being sued by 15 "hispanic" employees who say they were unfairly targeted. This should be an interesting case. If Damico's did fire only hispanic employees who didn't provide accurate SSNs when threatened with a deadline, they are idiots. Who are the rest? non-hispanic procrastinators? People on the lam living and working under assumed names? Why would they go to the trouble of singling out Mexicans and Central Americans?


The probability is that all of the people fired for having false or "innacurate" info are hispanic and they submitted false info because they don't have real legal info. Why else would someone not submit this info to their employer? It's illegal and the IRS will come after you when they find you, for payroll taxes. I can tell you, having come from a family where Dad was a legal immigrant and knowing other people from immigrant families, if you are hispanic and LEGAL, you do your utmost to make sure that whatever paperwork necessary gets done on time. The incentives to comply are huge. The disincentives to not comply are huge.

It will be interesting to see how far this case gets.
